Terms
Terms of Use
The rules for using Memory Postcards, in plain words.
These terms
These terms are an agreement between you and Practice Everything LLC, doing business as Memory Postcards (“we” or “us”). They cover the website and everything on it.
You agree to them when you tap a button whose line says so. That happens when you start asking, sign in, or send a story. If you don’t agree, please don’t use Memory Postcards.
Our Privacy Policy explains what we collect and why. It’s part of these terms.
You must be 18 or older
You must be 18 or older to make an account, ask a question, answer one, or record a story. Everyone heard or seen in a recording must be 18 or older too.
Family memories often include children. You may add a photo, or write or tell a story, that includes someone under 18, if you’re their parent or have a parent’s permission. Children may not use Memory Postcards themselves.
We don’t knowingly collect anything directly from anyone under 18. If you think someone under 18 has used it, email hello@practiceeverything.com. We’ll remove what they shared.
How it works
You ask someone a question and share a link with them. They answer with a video, their voice, or a few written words. They don’t need an account. When they tap Send, the story comes back to you.
Keep your sign-in email up to date and private. Anyone who can read it can sign in as you.
Your story stays yours
You keep whatever rights you already have in what you add. Neither we nor the person who asked becomes its owner. Adding something doesn’t make you the owner of someone else’s work. For example, being in a photo doesn’t make you its owner.
To run Memory Postcards, we need a limited permission. Whenever you upload, record, send or save anything here, you give us, and the companies that help us run it, permission to store it, copy it, convert it into formats that play, make a still picture for a postcard, and show it to the people it’s meant for. If someone orders a printed postcard, that includes printing and mailing it. This covers stories, recorded questions, photos, and recordings saved in person.
We use that permission only to run the service. We don’t sell what you add. We don’t use it in ads. We don’t use it to train AI. The permission ends when the content is deleted. The only exceptions are backups until they roll over, and print files we keep for a short time after an order, as our Privacy Policy explains. We use those only for that order, a reprint, a dispute or the law.
You promise you have the right to add what you add, and to let it be kept, shared and printed as these terms describe. That includes photos someone else took, and the voice, face or words of anyone else in it. Permission to record someone isn’t the same as permission to share it, so make sure you have both.
What the person who asked can do
When you send a story, the person who asked can:
- keep it in their account and download a copy;
- share it by link with people they choose;
- make printed postcards from it.
They may not:
- sell it, or use it in ads or for any business;
- edit it to change what you meant;
- post it publicly as their own work.
Recording with other people
Sometimes a story includes more than one person. You might record someone in person, or answer with a friend on camera.
Only record people who are 18 or older and say it’s OK. Ask each time. If someone in a story wants out, they can ask the person who saved it to delete it, or email us.
When you record someone in person and save it, you confirm everyone recorded is 18 or older and agreed. They agreed to be recorded, and for the story to be kept, shared by link and printed as these terms describe.
Links and postcard codes
A link or postcard code works like a key. Anyone who has it can open that card or set of cards, without signing in. It never opens anything else in your account.
Share links only with people you trust. Someone you share with can pass a link on. You can unshare a link or turn off a postcard code anytime, and it stops working for everyone.
Someone with a link can sign in to keep that postcard in their account. What they keep is a pointer, not a copy: it leaves their account when the link is unshared or stopped.
Email we send for you
When you tap Send to someone, we email them for you. The email shows your first name and comes from Memory Postcards. Add only people who would like to hear from you.
Every email has a link to stop our emails. We respect it.
Be kind and lawful
Please don’t use Memory Postcards to:
- harass, threaten, or harm anyone;
- record or share anyone without their OK;
- share sexual content, or anything that exploits or endangers a child;
- share violent content;
- pretend to be someone else;
- share things you don’t have the right to share;
- send spam, or ask strangers for stories in bulk;
- break the law, or try to break into our systems.
Reporting a problem
You don’t need an account to report something. Email hello@practiceeverything.com with the link or postcard code and what’s wrong. Tell us if you’re in it, or if you were recorded without your OK.
We look at every report. We may hide or remove a story, stop its links, or suspend an account while we look.
Copyright. If you think a story copies your work without permission, email hello@practiceeverything.com with: your name and contact details; the work you own; the link to the story; a statement that you believe in good faith the use isn’t allowed; a statement, under penalty of perjury, that your notice is accurate and you own the work or may act for the owner; and your signature.
Counter-notice. If we removed something you shared and you think it was a mistake, email hello@practiceeverything.com with: your name, address and phone number; what was removed and where it was; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; a statement that you agree to the federal court for your address (or, outside the U.S., any court where we can be found) and will accept service from the person who reported it; and your signature.
When we get a valid counter-notice, we’ll promptly send a copy to that person and tell them we’ll put the material back in 10 business days. We put it back 10 to 14 business days after we got your counter-notice, unless we first hear from them that they’ve filed a court action to stop the use. If we also removed it for another reason, such as privacy, we handle that reason separately.
We close the accounts of people who infringe again and again.
Suspending or closing an account
You can delete your account anytime in Settings. It happens right away and can’t be undone. We erase it, as our Privacy Policy explains.
We may suspend or close an account, or remove a story, if it breaks these terms, puts someone at risk, or the law requires it. When it’s safe and lawful, we’ll tell you why and give you a chance to download your stories.
What it costs
Your first 5 questions are free. We always show the price before you pay. We never charge you until you tap Pay.
Payments go through Stripe. We never see or store your full card number.
Printed postcards
Printed postcards are still being tested. These purchase terms apply once we start selling them.
- Price. You’ll see the full price, with shipping and any tax, before you tap Pay.
- Your OK. You approve how each card looks before we print it. We print what you approved.
- Who sells them. We sell the cards to you. Our printing partner prints and mails them for us. Bring any problem to us, not to the printer.
- Changing your mind. You can cancel for a full refund until the order goes to the printer. After that, you can’t cancel because you changed your mind. Your rights when cards ship late, below, still apply.
- Shipping. Before you pay, we show when we expect the cards to ship. If they can’t ship by then, we’ll email you with a new date. You can then cancel for a full refund. If we miss a new date or need more than 30 days past the first date, we’ll email you again, and we cancel and refund you unless you tell us to keep waiting. Once they ship, delivery times are the mail service’s estimate.
- Damaged or wrong cards. If cards arrive damaged, misprinted or different from what you approved, email hello@practiceeverything.com within 30 days of delivery. We’ll reprint them or refund you.
- Cards that never arrive. If cards haven’t arrived 14 days after they shipped, email us. We’ll check with the mail service, then reprint them or refund you. If the address you gave was wrong, we may charge for a reprint.
- Refunds go back to how you paid.
- The recording behind a card. A printed card’s code plays its story online. It keeps working while the story and the account stay here. It stops if the story is unshared or deleted, if the code is turned off, or if Memory Postcards closes. Buying cards doesn’t promise the recording will always be there. The card itself is yours to keep.
- Nothing here limits refunds or other rights the law gives you.
Keep your own copy
We work hard to keep your stories safe and available. Still, things break. Please download a copy of anything you can’t replace.
We may change or stop features. If we plan to close Memory Postcards, we’ll email account holders at least 30 days ahead so they can download their stories. People who answered without an account can ask the person they sent it to for a copy.
Sometimes we may have to stop all or part of it right away, for example for security, a legal order or something outside our control. If so, we’ll tell account holders as soon as we can, and help them get their stories if we’re able to.
Our promises, and their limits
We provide Memory Postcards “as is” and “as available.” To the extent the law allows, we make no other warranties. That includes merchantability, fitness for a particular purpose, and non-infringement.
To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages. That includes lost data or lost profits. Our total liability for any claim is the greater of what you paid us in the 12 months before it, or $50.
Some places don’t allow these limits. If so, they apply only as far as the law allows. Nothing here limits rights you have that can’t be waived.
California law
California law governs these terms, without regard to its conflict of law rules. Any dispute goes to the state or federal courts in California. You and we both agree to those courts.
Before going to court, please email hello@practiceeverything.com. Most problems can be fixed with a conversation.
When these terms change
If we change these terms, we’ll post the new version here with a new effective date. For a change that matters, we’ll email account holders at least 14 days before it takes effect. Each time you sign in, start asking or send a story, you agree to the version in effect then.
If you keep using Memory Postcards after a change takes effect, the new terms apply. If a part of these terms can’t be enforced, the rest still applies.
